Hiring a foreign talent

CAN A FOREIGN TALENT WORK IN AZERBAIJAN WITHOUT A WORK PERMIT?

Unless you are a permanent resident, any non-Azerbaijani national must have a work permit, commonly referred to as a “work visa”, in order to work in Azerbaijan.

There are some exceptional situations where foreigners and stateless persons are not required to obtain a work permit on the website of the “State Migration Service of the Republic of Azerbaijan” https://migration.gov.az/index.php/en/page/75

WORKER

Any capable foreigner over 18 years of age may work in the Republic of Azerbaijan after obtaining a work permit through legal entities, natural persons engaged in entrepreneurial activity without establishing legal entities, and branches and representative offices of foreign legal entities that employ him/her.

WHO APPLIES FOR A WORK PERMIT?

EMPLOYER

Legal entities, natural persons engaged in entrepreneurial activity without establishing legal entities, and branches and representative offices of foreign legal entities may employ foreigners and stateless persons only at their own place of work and must conclude an employment contract in accordance with the validity of the work permit. It is prohibited to conclude an employment contract with foreigners without obtaining a work permit.

The employer must submit the following documents in order to obtain a work permit:

  • Application form, a model of which has been approved by the Cabinet of Ministers of the Republic of Azerbaijan ;
  • Copy of passport or other border crossing document of a foreigner and stateless person;
  • Notarized copy of a document confirming that a foreigner and stateless person has the required qualification to perform the work in question;
  • Reference justifying the necessity of employing the foreigner and stateless person in the intended job;
  • Reference certifying that the foreigner or stateless person is not a carrier of a disease included in the list of dangerous infectious diseases (human immunodeficiency virus infection, hepatitis B and hepatitis C) approved by the competent executive authority.

DEADLINES

Applications for work permits are processed within the time limit stipulated by the Law of the Republic of Azerbaijan “On State Fees” in accordance with the amount of state fees paid under this law.

The work permit is issued for 1 year or if the work contract is concluded for a period of less than 1 year, it is issued for this period.

WHAT HAPPENS TO THE FOREIGN EMPLOYEE YOU HIRED ONCE THE WORK PERMIT EXPIRES?

A work permit is not automatically renewed. The validity period of the work permit can be extended each time for a maximum of one year.

To extend the validity of the work permit, the employer must submit an application to the National Migration Service at least 30 days prior to its expiration.

The employer must submit the following documents for the extension of the work permit:

  • Application form, including a sample approved by the competent executive authority;
  • Notarized copy of a document confirming that a foreigner or stateless person has the required qualification to perform the work in question;
  • Reference justifying the necessity of employing the foreigner or stateless person in the contemplated job;
  • Reference certifying that the foreigner or stateless person is not a carrier of a disease included in the list of dangerous infectious diseases (human immunodeficiency virus infection, hepatitis B and hepatitis C) approved by the competent executive authority.
